US Federal Communications Commission’s Recent Order Expands Potential Liability under the Telephone Consumer Protection Act for Business-to-Customer Calls and Text Messages

On July 10, 2015, the Federal Communications Commission (FCC) issued a Declaratory Ruling and Order responding to almost two dozen pending petitions concerning the Telephone Consumer Protection Act (TCPA) and its implementing regulations. Unfortunately, numerous aspects of the ruling threaten to expand liability for businesses that engage in certain automated-dialing or texting practices.
