Organization for International Investment’s General Counsel Conference

Mayer Brown is sponsoring the Organization for International Investment (OFII) General Counsel conference. The conference takes place on October 27 and 28 (Thursday and Friday) in Washington DC. General Counsels in attendance are GC’s of US subsidiaries of foreign-based parent companies.

Rebecca Eisner will participate in a panel entitled “Data Privacy & the Changing Regulatory Framework.” This panel will cover the US statutory and regulatory developments and recent litigation relat­ing to data privacy with an emphasis on how the changing regulatory framework may impact US subsidiaries and their foreign parent companies, including their US and global policies and procedures. In particular, the panel will discuss the following topics:

  • US privacy risks associated with the collection and use of personal information, “big data” and the Internet of Things, with a focus on developing policies and procedures for US companies that report to foreign parent companies
  • Privacy considerations with respect to cross-border data transfers among US and non-US affiliates in global companies, including Privacy Shield and General Data Protection Regulation (GDPR) and the authority of the US government with respect to information maintained in the US and abroad
  • Due diligence, contractual protections and ongoing oversight of vendors and other third party service providers with access to sensitive personal information
  • US litigation risks and the evolving US framework for liability arising out of data privacy incidents.
