Non-party costs orders: English High Court grants order against Claimant's group company

An adverse costs order is but one of the risks parties to litigation run. That risk, in recent years, has increasingly extended to non-parties, based upon the court’s jurisdiction to award costs against non-parties set out in section 51(1) and (3) of the Senior Courts Act 1981, albeit such orders are “exceptional”.
