New Laws in US Ban Salary History Inquiries

Numerous states and cities—including California, Delaware, Massachusetts, Oregon, New York City, Philadelphia and San Francisco—have recently passed laws prohibiting employers from requesting an applicant’s salary history during the hiring process. These laws were passed in an effort to eliminate pay disparities based on gender. This Legal Update first summarizes the laws and then describes steps that employers should consider taking to comply with these laws.
