Mayer Brown JSM secures positive outcome for Lianzhong in Vietnam’s first-ever antidumping case

9 September 2014
Mayer Brown today announced that it has secured a significantly lower antidumping duty rate for Chinese stainless steel manufacturer Lianzhong Stainless Steel Corporation (Lianzhong) in the first ever anti-dumping investigation initiated by the government of Vietnam. The product covered by the investigation was a certain cold-rolled stainless steel (CRSS).

This success allows Lianzhong to continue exporting CRSS to Vietnam at a significantly lower rate of duty, compared with the 6.58 to 37.29 percent duty rates currently imposed on other exporters being investigated in this case. The lower duty greatly reduces Lianzhong’s capital spending on customs taxes, placing the company in a stronger competitive position in the Vietnam market.

Matthew McConkey, partner at Mayer Brown who led the case, commented, "We are delighted to have successfully secured a favourable duty for our client in this first-ever anti-dumping case brought in Vietnam. Our award-winning International Trade group has depth and breadth in filing and defending for clients on trade issues and is one of the few international law firms to have such expertise in Vietnam."

Other lawyers who worked on this case include associate Hai Nguyen and consultant Hung Nguyen, both of Mayer Brown’s Ho Chi Minh City office in Vietnam.

Mayer Brown has been representing various Vietnamese companies, including Vinh Hoan Corporation (one of the top seafood companies in Vietnam) and the Vietnam Association of Seafood Exporters and Producers (VASEP) in the tra fish and warm water shrimp cases initiated by the U.S. Department of Commerce. Recently, Mayer Brown has successfully secured a duty rate of zero percent for Vinh Hoan Corporation in the tra fish case, saving our client millions of US dollars in potential duties.

Adding further strength to our capabilities in anti-dumping and other trade-related matters, Mayer Brown recently established Mayer Brown Consulting. It consists a group of highly experienced customs and international trade advisors who are working with our lawyers in the International Trade group at Mayer Brown to advise clients on a wide range of Asia-focused international trade matters including WTO issues, international trade policies, customs, export controls, as well as anti-dumping investigations.
