H-1B Cap for FY 2019 Reached

On April 6, 2018, US Citizenship and Immigration Services (USCIS) advised that it has reached the congressionally mandated annual quota for H-1B visa cap petitions, which allow US employers to recruit and employ foreign professionals working in specialty occupations. This is the sixth year in a row in which the cap was reached within the first five working days of April, the “H-1B acceptance period” for “first in time” filings. USCIS has not yet released the total number of petitions filed, although that figure likely exceeds the quota—65,000 under the bachelor’s degree quota and 20,000 under the US advanced degree exemption. USCIS has not advised on the timing for conducting a lottery to select petitions for processing under the quota. We will report further on the H-1B Cap as additional information becomes available from USCIS.
