German Ministry activates the Foreign Investment Regime

Foreign Direct Investment (“FDI”) screening procedures have become of particular interest in M&A scenarios worldwide. Besides the US and Great Britain, Germany has tightened its FDI review procedures in July 2017 and now, executive orders, including an almost issued prohibition for a certain FDI for the first time ever, illustrate the German government’s determination to secure critical infrastructure in Germany. The Legal Update summarizes the recent executive and legislative developments in Germany and the European Union highlighting the key indications for M&A deals.
