Gabriela Kennedy and Maggie Lee contribute article on PRC landmark decision on online streaming

The latest issue of Leading Internet Case Law journal features an article by Gabriela Kennedy and Maggie Lee on a recent decision by the Beijing IP on streaming. The authors discuss the landmark decision of the case brought by Beijing Sina Internet Information Services Co. Ltd (“Sina”) against the Beijing Tianying Jiuzhou Network Technology Co. Ltd (“Tianying”) for unauthorised online broadcasting of public television signals for live Chinese Super League football matches (“Football Matches”).

Sina owns the exclusive rights to broadcast the Football Matches while Tianying operated an online portal which streamed live the Football Matches. Sina alleged that Tianying had, amongst other things, infringed Sina’s copyright in the broadcasts of the Football Matches, which it claimed to be protectable under the PRC Copyright Law as “works created by methods similar to the filming of movies”.
