Frozen out: The importance of complying with the duty of full and frank disclosure when applying for a freezing injunction

In this alert we consider the recent Commercial Court judgment in Banca Turco Romana SA v Cortuk & Ors1 which concerned applications for freezing orders against third parties to a fraud claim. The freezing injunctions were set aside on the basis of a number of material non-disclosures made by the applicant.
