Current State of Data Protection Regulation in Asia

​Gabriela Kennedy delivered a seminar titled, “Current State of Data Protection Regulation in Asia” to Bloomberg on 26 April 2018. Approximately 20 members of Bloomberg's Asian and US legal and compliance team joined to hear Gabriela provide a comparative analysis of data protection laws and regulations across Asia.

Gabriela opened the seminar with welcoming remarks before she began her presentation with a general overview of the core principles of data protection and explained the elements and types of cybersecurity regulations in Asia. She explored the features and principles of the Asia Pacific Economic Cooperation (APEC) Privacy Framework, and the APEC Cross-border Privacy Enforcement Arrangement (CPEA). Gabriela also talked about the APEC Cross-Border Privacy Rules (CBPR) System, before going through the data protection regimes and major statutory requirements across Asia.

Gabriela then examined the current state of data protection regulation in Asian jurisdictions in particularly China, Singapore and South Korea. She looked at recent regulatory developments in each of these jurisdictions, the risks of failing to comply with respective data privacy laws and risks relating to cross-border data transfer. Gabriela also looked at the impact on businesses in Asia ,of the EU GDPR which will come into effect from May 2018, tightening restrictions on the collection and use of personal data. She went through the key changes under the GDPR and how they apply to Bloomberg entities before wrapping up the seminar by sharing some tips to be adopted to prepare for the GDPR.
