Cram-Down in the UK: Another Option for Restructuring New York Law Bonds?

Please join us for a review of the recent DTEK case, in which the High Court in England sanctioned the restructuring of bonds issued by a Netherlands company following a change of governing law from New York to English law. Devi Shah, co-head of Mayer Brown’s Restructuring, Bankruptcy and Insolvency team in London, will provide a brief outline of the English law process used for the restructuring (a “scheme of arrangement”), a summary of the DTEK decision and an overview of the legal and practical implications.

Mayer Brown’s Global Financial Markets Initiative helps clients deal with the legal and business challenges resulting from the ongoing turbulence in worldwide financial markets. By mobilizing the firm’s global resources from multiple practices and offices, the initiative provides clients with knowledgeable and timely counsel on a broad spectrum of their legal needs.
