Court of Federal Claims Fumbles Section 1603 Discovery Dispute

In a bylined article, Tax Transactions & Consulting partner David Burton (New York) writes that the Court of Federal Claims in Bishop Hill Energy LLC v. United States appears to have fumbled its analysis of why Treasury shouldn’t have to produce documents related to other cash grant awards for wind energy projects after disallowing part of the petitioner’s claim.
