Mayer Brown scores double victory for AT&T in class action suits

Mayer Brown, a leading global law firm, scored a double victory in the Appellate Court of Illinois on June 28, 2013 on behalf of AT&T in two class action suits. In each case, plaintiffs sought a mass refund of all late-payment charges assessed by AT&T Illinois for an eight year period—totaling more than $120 million.

The first appeal, No. 11-3349, was brought under a 1993 settlement agreement. The second appeal, No. 11-3350, sought the same result under an Illinois Commerce Commission regulation. Mayer Brown persuaded the circuit court to enter summary judgment in the “agreement” case, and to dismiss the “regulation” case because the Commission has exclusive jurisdiction over claims for reparations. Plaintiffs appealed, but the Appellate Court affirmed in AT&T’s favor in all respects.
