Tauil & Chequer Legal Update

On May 12, 2016, the National Agency of Petroleum, Natural Gas and Biofuels – ANP published Resolution No. 21/2016, which establishes rules regarding production, trade and use of experimental fuel in Brazilian territory.

Experimental fuels are defined as fuels or biofuels that do not yet have specification from ANP and they can be used in small amounts without prior authorization from ANP. The Agency's approval is required when used in amounts that exceed 10 m³ (liquid fuels) and 10,000 m³, 20ºC and 1 atm (gas fuels), whether their consumption be during a specific or an indefinite period of time.

The Resolution unifies all types of experimental fuels under the same regulation. It is important to mention that the prior authorization from ANP for the use of experimental fuels does not apply to air transportation projects.

The complete resolution is available on ANP’s official website (Portuguese only).
