2016 Inter-Court Conference

On September 28, Rajesh De will participate as a panelist at the 2016 Inter-Court Conference in Asheville, NC, sponsored by the Supreme Court of North Carolina, the National Center for State Courts, and the Federal Judicial Center.  The topic is “Brave New World:  Balancing Civil Liberties and National Security in the Twenty-first Century.”  Along with Erwin Chemerinsky (University of California, Irvine) and Charles Dunlap (Duke University), Raj will focus particularly on the issue of Cybersecurity and will address questions such as:

  • What do you see as some of the most important matters for us to consider as cybersecurity threats increase?
  • Do current legal standards adequately provide the government with the ability to fight cybercrime?
  • What implications may there be for civil liberties in these efforts?
  • What concerns should judicial officials and administrators be aware of with regard to cybersecurity?
  • What is the authority of U.S. courts to address cyberattacks by a foreign nation-state?
  • How should the analysis change—if at all—for domestic threats created by American citizens?
  • What should courts be doing to prepare for claims that election results or vote counts are being manipulated by hackers, whether foreign or domestic?”
