Last month, the Legislative Council Panel on Manpower reviewed and discussed a briefing paper submitted by the Labour and Welfare Bureau of the Labour Department. The paper proposes amendments to the Employment Ordinance which currently requires Labour Tribunal orders for re-instatement or re-engagement of an employee to be made with the consent of both parties.

On 6 February 2013, the Government of Vietnam issued Decree No. 15/2013/ND-CP guiding the implementation of the Construction Law dated 26 November 2003 (Decree 15). Decree 15 came into effect on 15 April 2013 and replaces Decree No. 209/2004/ND-CP dated 16 December 2004, and Decree No. 49/2008/ND-CP dated 18 April 2008. It also replaces a number of clauses in Decree No. 12/2009/ND-CP dated 12 February 2009. Provisions in Decree 15 on utilising information concerning the capabilities of organisations and individuals for contractor selection, however, will take effect on 1 September 2013.

As part of a continued move toward greater transparency in China's merger control regime, the Chinese Ministry of Commerce (MOFCOM) published for public comment on 27 March 2013 draft Regulations on the Imposition of Restrictive Conditions on Concentrations of Business Operators (Draft Restrictive Conditions Regulations). The consultation closes on 26 April. The new draft rules are comprehensive in scope and largely in line with mainstream international practice – notably in the EU.
