The 2010 Affordable Care Act encourages the formation of Accountable Care Organizations (ACOs) by hospitals and other health care providers to reduce health care costs and improve quality of care. This article describes the Statement of Antitrust Enforcement Policy Regarding ACOs issued last year by the Federal Trade Commission and the Department of Justice and identifies concerns that the Policy Statement may permit the formation of ACOs that can exercise market power in negotiating with commercial health plans.
