The use of unauthorised software in business is illegal and is likely to attract both civil and criminal liabilities in Hong Kong. Yet, did you know that the use of unauthorised software by anyone whose goods are supplied to the US may also constitute an unfair trade practice under the US's unfair competition laws, and may lead to the detention of goods, financial liability and injunctions against further sales? A Thai company has recently been fined for using pirated software to gain an unfair trade advantage in Massachusetts. The lessons that can be learnt by other Asian businesses from this very first case under the US's new anti-IT theft approach are discussed in this legal update.

Trademark squatting has been a nightmare for many overseas trademark owners for a long time, and more so in recent years. Our partner, Kenny Wong, published an article last month in Intellectual Property Magazine, titled "Kung fu trademark hustle", in which he says there are encouraging signs that we may be seeing light at the end of the tunnel.
Following the Trademark Office, the Chinese judiciary has also openly acknowledged the problem. On December 3, the Beijing No. 1 Intermediate People's Court held a press conference to report on their study into "the cause, characteristic and judicial response to trademark squatting".

On 22 August 2012, the U.S. Securities Exchange Commission (the “SEC”) adopted a final rule (the “Rule”) pursuant to the directives of the 2010 Dodd-Frank Wall Street Reform and Consumer Protection Act (“Dodd-Frank”) compelling certain companies with U.S. securities reporting obligations (“Reporting Companies”) to assess and disclose their use of “conflict minerals,” consisting of certain metals (including tin, titanium, tungsten and gold) originating from certain targeted sources supporting conflict in the Democratic Republic of Congo (DRC) or adjoining countries (together with the DRC, the “Covered Countries”). This article evaluates the impact of the Rule on these Asian manufacturers.
