Experience
Andrea Hutchison’s practice focuses on patent litigation, patent procurement and counseling with particular emphasis on pharmaceutical patent litigation. She has led teams in developing litigation strategy for patent cases that have proceeded to trial, arbitration, mediation and settlement.
Ms. Hutchison has experience in technologies involving pharmaceuticals, biologics, methods of treating gastrointestinal disorders, medical devices, nutraceuticals, gaming devices and business methods. She has provided strategic advice regarding licensing, freedom to operate, patent prosecution and portfolio management.
Prior to joining Mayer Brown, Ms. Hutchison advised pharmaceutical, biotechnology and medical device clients on strategies to increase profits, evaluate new markets and gain a competitive edge for innovative technologies. She has counseled pharmaceutical clients seeking to redesign their product pipeline and has identified potential targets for pharmaceutical clients seeking to acquire new technologies. - Representing the patentee in an infringement action brought under the Hatch-Waxman Act and proceeding through trial regarding a proton pump inhibitor pharmaceutical product.
- Representing a global branded pharmaceutical company against claims of alleged infringement of a formulation patent relating to a blood clotting factor.
- Representing two national financial institutions charged with infringing business method patents in litigations that resulted in dismissals of the plaintiffs’ complaints.
- Representing a global food, agricultural and industrial producer in an infringement action before the US International Trade Commission involving glucosamine.
- Representing a global manufacturer of gaming machines on appeal to the Federal Circuit that resulted in a favorable affirmance.
- Providing strategic advice regarding licensing, protection of intellectual property, freedom to operate and patent portfolio management including Orange Book listings, reissues and reexamination.
- Teaching Patent Law at Northwestern University as an Adjunct Professor of Law.
