Part VIA of the Personal Data (Privacy) Ordinance (Cap. 486) (PDPO) sets out new direct marketing requirements. Part VIA will tentatively commence on 1 April 2013. In anticipation of its commencement, the Privacy Commissioner for Personal Data (PCPD) has issued a Guidance Note on Direct Marketing (Guidance Note). The Guidance Note will take effect when Part VIA commences.

Data processors are now able to apply to use Binding Corporate Rules (BCRs) in order to move personal data outside of the European Economic Area while complying with European data protection legislation instead of having to implement and maintain sophisticated networks of data transfer contracts in the form of the standard contractual clauses approved by the European Commission.

On 23 October 2012 the Vietnamese Government issued Decree No. 88/2012/ND-CP (Decree 88) regulating the information and press activities of foreign correspondents and foreign agencies and organisations in Vietnam.

Decree 88 will take effect from 20 December 2012 and replace Decree No. 67/CP dated 31 October 1996 (Decree 67). Decree 67 was the first Government decree issuing regulations on the information and press activities of foreign correspondents and foreign agencies and organisations in Vietnam.

Of note, journalists of foreign news organisations working in Vietnam will be allowed to directly contact ministries and other authorities for reporting purposes instead of having to go through the Ministry of Foreign Affairs as under Decree 67.

This legal update is part of our series of updates to discuss the implications of the Personal Data (Privacy) Amendment Ordinance 2012 ("Amendment Ordinance").

In this legal update, we look at a new criminal offence created under the Amendment Ordinance which prohibits the disclosure of personal data kept by a data user without the data user’s consent.

An example of where this provision applies is where an employee sells personal data obtained in the course of his employment to a marketing company. The new provision in the Amendment Ordinance makes the employee criminally liable for the unauthorised disclosure of the personal data.

The Personal Data (Privacy) Amendment Ordinance 2012 will come into force in Hong Kong on 1st October 2012.

This legal update is part of our series of updates to discuss its implications for employers and other data users.

In this legal update, we look at a data user's obligations when engaging third party processors such as payroll agents, pension administrators, external IT consultants, and waste disposal/ shredding companies. We also look at ways of discharging these new obligations.

The US District Court for the Northern District of Illinois recently granted summary judgment to a plaintiff in a putative class action under the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227, on the question of whether she provided express consent to receive calls from an automatic telephone dialing system, denying the defendant’s attempt to end the suit.

The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, prohibits placing calls using an “automatic telephone dialing system” to wireless phone numbers—absent the recipient’s prior consent or an emergency situation—and provides for statutory damages of up to $1,500 per violation.
