Following a lengthy review lasting the best part of a year, on 16 April 2013 the Ministry of Commerce of the People's Republic of China (MOFCOM) gave a conditional green light to the acquisition by Glencore International plc. (Glencore) of all of the remaining shares of Xstrata plc. (Xstrata), in which Glencore already held a minority equity interest.

Ethiopia has many of the essential elements required for success as a mining nation. It is unquestionably resource rich, with a vast breadth of undeveloped minerals and resources, including significant gold and tantalum deposits. Positioned in the Horn of Africa, it is also strategically located for foreign investment from Europe, Asia and Australia. Finally, together with a stable political environment and a recently revamped mining code it is highly attractive to investors. Indeed, its mining code has been designed to promote transparency and fair investment in Ethiopia and is similar to the best practices of well-known mining countries. Public enterprises continue to dominate Ethiopia’s developing economy, but the potential for private investment remains largely untapped.

In a unanimous opinion, the Illinois Supreme Court has ruled that the citizen suit provision of the Illinois Surface Coal Mining Land Conservation and Reclamation Act, 225 ILCS 705, et seq. (the “Mining Act”), does not allow for judicial review of the terms of mining permits issued by the Illinois Department of Natural Resources (IDNR)—even if it is alleged that permit terms violate the Mining Act itself.

At a meeting held in Lomé from 13 to 15 December 2010, the OHADA council of Ministers adopted the new OHADA Uniform Act Organizing Securities (the “Uniform Act”) which brings major changes to the existing legislation dated April 17, 1997. The Uniform Act was published in the OHADA’s official journal on15 February 2011 and will take effect on 16 May 2011.
