These suits frequently allege that the plan’s fiduciaries breached their duties by overpaying for administrative costs or choosing imprudent investments. This panel will discuss ERISA legal developments and practices companies can use to mitigate associated legal risks, including with respect to:

  • Minimizing the risk of adverse litigation against retirement plan sponsors, including best practices in light of the onslaught of new suits
  • Managing plan sponsor and employee costs
  • Navigating the DOL’s new ESG rule for retirement plans

Environmental, Social and Governance (ESG)

Businesses today are inseparable from the environment in which they operate and the society they serve, and stakeholders understand that ESG gives rise to both risks and opportunities. This panel will discuss recent developments impacting ESG-related initiatives, including:

  • ESG regulation, including the SEC’s proposed climate disclosure rule, social and green financing, and impact investing
  • The anti-ESG movement, including the rise of AG suits, ESG-related legislation, and what a change in administration could mean for ESG investing
  • Diversity, equity and inclusion, including the relevance of HR management for ESG strategies and international standardization initiatives
